LEASE AGREEMENT
BETWEEN
___________________________________________________,
LESSEE AND FREEDOM IS NOT DEAD INC.(FIND), AN ARKANSAS
"Not for Profit" CORPORATION WHICH HOLDS LAND
IN TEXAS, LANDLORD
This agreement
commemorates the agreement between the two parties listed
above and, along with the lease application, is the
entire agreement except as specifically stated herein.
- For the sum
of one thousand dollars ($1,000.00) cash paid
upon application for consideration, Landlord
grants to Lessee the right to use the surface of
a piece of real estate owned by Landlord, of at
least a size containing a rectangle 75 feet by 50
feet, the specific location on the owned property
to be determined upon first actual visit to the
property by Lessee. Landlord shall, if
available, offer to Lessee a choice of at least
two locations of said size, the locations and
boundaries of to be the sole discretion of
Landlord.
- Landlord
shall be responsible for the ad valorem taxes of
the premises at the rate of the agricultural
exemption applied to the agricultural land
otherwise held by the Landlord in the same
general area. Any amount over and above
this figure, if any, shall be the responsibility
of the Lessee. In other words, Lessee
pays the taxes for any improvements made.
- For the sum
of five thousand five hundred dollars ($5,500.00)
cash paid upon application for consideration,
Landlord grants to Lessee the right to use the
surface of a piece of real estate owned by
Landlord, of at least a size containing a
rectangle one (1) full acre home site, the
specific location on the owned property to be
determined upon first actual visit to the
property by Lessee.
This lease of
surface shall last 99 years, and shall be transferable by
provision of this original lease AND a notarized letter
from Lessee which specifically assigns this lease to
another party. Presentation of these two documents
in person at Lessors offices on the premises
containing the leased land by the assignee shall result
in that lease being voided, and a new, transferable,
lease being executed between the assignee and Landlord
for the remaining term. Multiple transfers with all
relevant original paperwork will be honored by Landlord.
RIGHTS AND
RESPONSIBILITIES --OF LESSEE:
- Lessee
accepts property in as-is condition, with all its
faults, whatever they may be.
- Lessee will
check-in with Landlord and identify
self prior to initial occupation. This will
be the only required periodic check in except
that if Lessee intends to abandon property,
Lessee will make every attempt to so inform
Landlord as soon as is possible after the
decision or the actual abandonment.
- Lessee
understands that Landlord may use the property
for agricultural purposes prior to occupation by
Lessee, and, upon occupation, shall give the
lessor sufficient time to remove any property or
animals which may be on premises.
- Lessee
shall occupy property quietly and peacefully with
no avoidable noise emitted past boundaries of
leased property. Reasonable exceptions
include operation of machinery, thoughtful and
considered discharge of firearms, and the like,
which cannot be muffled.
- Lessee
shall keep premises sanitary. Human and/or
animal waste produced on property shall be kept
in such manners as to not cause odors to drift
beyond boundaries of premises.
- Lessee
agrees to be completely, totally, unwaveringly
responsible for security while present or absent
after his initial occupation of premises.
Lessee further agrees to hold harmless and defend
Landlord from any claim relating to any security
issue.
- Lessee
agrees to bind any resident, temporary or
otherwise, who might occupy his premises to the
terms of this lease, and to assist and cooperate
with Landlord in enforcing the terms of this
lease.
OF LANDLORD
- Landlord
shall hold property available for Lessee through
the entire lease term, if necessary.
- Landlord
will be available during normal business hours,
or by appointment at any mutually agreeable time,
for initial occupation check-in and premise
choosing process.
- Landlord
reserves the right to use any and all leased
premises for agricultural use so long as initial
occupation has not occurred OR Lessee is absent
for 30 or more days. In the latter case,
Landlord will not alter, remove, or willfully
damage any personal property or improvements, if
any, left by Lessee, and will take all
appropriate cautions to work around such
improvements or personal property, if any.
- Landlord
shall not be held responsible for the loss,
theft, or any other conversion or disappearance
of any thing or condition left unattended by the
Lessee.
FURTHER,
- LESSEE
UNDERSTANDS THAT THIS AGREEMENT IN NO WAY SHOULD
BE CONSTRUED AS A DOCUMENT CONVEYING TITLE TO ANY
REAL ESTATE WHATSOEVER. THIS IS A SURFACE
LEASE ONLY WITH NO RIGHT OF OWNERSHIP ATTACHED. ( Actual ownership will reside with the
Land Trust to protect all residents from loss of
tenant privileges for the duration of the lease
agreement)
- LANDLORD
MAKES NO GUARANTEES NOR REPRESENTATIONS OF THE
AVAILABILITY OR PRESENCE OF ANY IMPROVEMENTS,
INCLUDING BUT NOT LIMITED TO ELECTRICAL SERVICE,
WATER WELLS OR TAPS, OR SANITARY DISPOSAL
SYSTEMS.
- LESSEE WILL
PROVIDE AT HIS SOLE EXPENSE ANY SUCH IMPROVEMENTS
AS DESCRIBED IN POINT 2 WHICH LESSEE
DESIRES.
- LANDLORD
WILL NOT NOW NOR IN THE FUTURE REQUIRE ANY SUCH
IMPROVEMENTS, NOR WILL LANDLORD BE OBLIGATED TO
COMPENSATE LESSEE IN ANY FORM FOR SUCH
IMPROVEMENTS.
- LESSEE
AGREES AND UNDERSTANDS THAT CHARACTER, INTEGRITY,
AND SELF-RELIANCE ARE NECESSARY FOR HUMAN LIFE
AND PROSPERITY. TO THAT END, IT IS
EXPRESSLY STATED AS PART OF THIS LEASE AGREEMENT
THAT LESSEE SHALL AT ALL TIMES PROVIDE FOR
HIMSELF IN EVERY RESPECT, TO THE BEST OF HIS
INTELLECTUAL AND PHYSICAL ABILITY, AND ENSURE
THAT ALL RESIDENTS OF HIS PREMISES CONDUCT
THEMSELVES IN LIKE MANNER.
- LESSEE
UNDERSTANDS, AND LANDLORD AGREES, THAT THE ONLY
CAUSE FOR EARLY TERMINATION OF THIS LEASE WILL BE
SPECIFIC BREACH OF CONTRACT OF THIS LEASE.
- Absolutely
No refunds after Sept. 26th. 2009

HANDS ON DATES STATED BELOW, THAT THIS DOCUMENT IS FULLY
UNDERSTOOD AND WILL BE FOLLOWED.
